These Terms of Service ("Terms") govern your access to and use of the BoomOut website and mobile application (the "Service"), operated by BoomOut, Inc. ("BoomOut"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 16 years old and able to form a binding contract to use the Service. By using BoomOut you confirm both.
2. Accounts
- You are responsible for the security of your credentials and for activity under your account.
- Provide accurate information and keep it up to date.
- One person may not operate multiple accounts to manipulate feed placement, likes, or propagation reach.
3. Content you post
- You keep ownership of the content you post. You grant BoomOut a non-exclusive, worldwide licence to host, display, and distribute your content within the Service, including via the propagation features that show your posts to other users.
- You may only post content you have the right to share. Do not post stolen media or content that infringes someone else's intellectual property.
- Prohibited content includes: unlawful material; hate speech and harassment; graphic violence posted to shock; sexual content involving minors or non-consensual intimate imagery; spam, scams, and misleading metadata; and content designed to manipulate our ranking or membership systems.
4. Moderation
We review reported content and may remove or restrict anything that violates these Terms or is unlawful, at our discretion. We will explain removals where practicable and you may appeal through the in-app feedback channel or our contact page.
5. Membership and payments
BoomOut offers free and paid membership tiers. Paid tiers renew until cancelled, prices are shown at checkout, and unused periods are non-refundable except where required by law. We may change tier benefits with reasonable notice.
6. Advertising
The free Service is supported by advertising shown alongside community content and clearly labelled as such. Third-party ad partners may serve personalised ads as described in our Privacy Policy. BoomOut is not responsible for the content of third-party advertisements; please report problematic ads to us with the advertiser's name and a screenshot.
7. Acceptable use
- Do not scrape, frame, or reverse-engineer the Service or its APIs.
- Do not interfere with other users' experience, our networks, or safety systems.
- Do not resell the Service or use it for commercial purposes not authorised by us.
8. Intellectual property
The BoomOut name, logo, and original interface designs are our property. Other brands and content belong to their owners. Nothing in these Terms grants you the right to use them.
9. Disclaimers and liability
The Service is provided "as is" without warranties to the maximum extent permitted by law. To the extent permitted, BoomOut is not liable for indirect or consequential losses, and our aggregate liability for any claim is limited to the amount you paid us in the twelve months before the claim (or US$100 if you paid nothing). Some jurisdictions do not allow these limitations; in that case they apply only to the maximum legal extent.
10. Termination
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms or where required by law, with notice where practicable.
11. Changes
We may update these Terms; material changes will be announced in the Service at least 14 days before taking effect where required by law. Continued use after changes take effect means you accept them.
12. Governing law and contact
